Terms of Service — Ladybug Scoops LLC

1. Ladybug Scoops Terms of Service
By initiating or continuing service with Ladybug Scoops, you agree to the following Terms of Service.
2. Service & Scheduling
Ladybug Scoops provides a recurring dog waste cleanup service based on an established route schedule. Your assigned service day is determined by your address and how it fits within our existing routes.
While your service day will generally remain the same, Ladybug Scoops reserves the right to adjust service days as routes change. We will make reasonable efforts to notify you in advance of any permanent or temporary schedule changes.
The time of day your service is completed will vary and cannot be guaranteed. Our technicians may begin service as early as 7:00 a.m. Customers should not rely on a specific arrival time unless otherwise arranged in writing.
We work rain or shine and make every reasonable effort to complete service on your scheduled day. Severe weather, unsafe road conditions, wildfires, natural disasters, vehicle issues, employee illness, or other circumstances outside our reasonable control may occasionally delay or prevent service.
If a service cannot be safely completed or rescheduled before your next scheduled visit, the missed visit is not eligible for credit. Accumulated waste will be removed during the next scheduled service.
3. Billing & Payment
Ladybug Scoops is a prepaid recurring subscription service. All recurring service customers are required to maintain a valid credit or debit card on file.
Recurring service is automatically billed to the card on file on the 1st of each month for that month's service.
Our monthly pricing is an annualized flat rate calculated using the weekly service rate:
Weekly Rate × 52 Weeks ÷ 12 Months
Because the rate is annualized, your monthly invoice remains consistent regardless of whether a particular month contains four or five scheduled service days.
The monthly rate is based on maintaining your recurring service schedule throughout the year and is not calculated according to the exact number of visits completed during an individual calendar month.
You authorize Ladybug Scoops to charge the card on file for recurring monthly service and for any additional services or applicable charges incurred under this agreement, including additional cleanup or bag fees, additional dogs, deodorizing treatments, or other services you request or authorize.
Customers are responsible for maintaining a valid payment method.
If payment has not been received before the first scheduled service of the month, service may be suspended until the account is brought current. A payment-related suspension does not reduce the monthly service charge, and missed visits resulting from nonpayment are not eligible for credit.
If more than two weeks pass before payment is received and service resumes, accumulated waste may require additional cleanup, and additional bag or cleanup fees may apply.
4. Changes to Your Service
Pricing is based on the information provided when service is established, including the number of dogs, service frequency, yard size, service area, and other conditions affecting the service.
Customers are responsible for notifying Ladybug Scoops of changes that may affect their service, including:
- Changes in the number of dogs at the property, including regularly visiting or guest dogs
- Changes to the yard or areas requiring service
- Changes to gate access, locks, or entry instructions
- Changes in a dog's behavior or safety status
- Changes to contact information or payment information
Ladybug Scoops reserves the right to adjust pricing when the number of dogs, service area, yard conditions, service frequency, or other circumstances affecting the amount of work required have changed.
5. Property & Gate Access
Customers are responsible for providing safe and reliable access to the service area on the scheduled service day.
Gates must be unlocked, accessible, and in good working order. If a lock is required, an inline combination lock must be used. Ladybug Scoops is happy to provide an appropriate lock when needed.
If our technician cannot safely access or service the yard due to a locked or obstructed gate, damaged gate or latch, aggressive or unsecured dog, construction, unsafe conditions, or another access issue, the visit will be considered a missed service and is not eligible for credit.
Accumulated waste will be removed during the next scheduled service. If conditions result in an excessive accumulation of waste, additional cleanup or bag fees may apply.
Customers are responsible for maintaining a reasonably safe and accessible service area. This includes addressing hazards such as damaged gates, holes, exposed wires, irrigation equipment, low-hanging branches, unrolled hoses, construction materials, chemicals, sharp objects, excessive debris, or other conditions that could present a risk to our technicians.
Lawns should be regularly maintained, and leaves, debris, excessive vegetation, and other materials should be removed whenever possible.
If we cannot see it, we cannot scoop it.
6. Dogs & Technician Safety
The safety of our technicians, customers, and pets is extremely important to us.
Dogs may remain in the yard during service when the technician is comfortable servicing the property with the dog present. Ladybug Scoops and its technicians have sole discretion to determine whether a dog or situation presents a safety concern.
If at any time a technician feels uncomfortable or unsafe around a dog, the dog must be secured indoors or otherwise completely separated from the service area before service can be completed.
Properties involving dogs that are aggressive, protective, unpredictable, or otherwise considered a potential safety concern may be placed under our Dangerous Dog Policy. These properties may require confirmation that the dog has been secured before our technician enters the yard.
If required confirmation is not received, or if a dog is not properly secured when our technician arrives, service may be skipped and the visit will remain chargeable.
Ladybug Scoops reserves the right to immediately leave a property or discontinue service if a technician believes a dog or other condition presents a safety risk.
Customers are responsible for ensuring their dogs are current on vaccinations required by law and appropriate for their age and circumstances.
7. Dog Treats
Our technicians may carry dog treats and may offer them to friendly dogs during service.
Customers are responsible for notifying Ladybug Scoops of any food allergies or dietary restrictions or if they do not want their dog(s) to receive treats.
8. Waste Disposal & Sanitation
After service, collected dog waste is bagged and placed in the customer's designated trash receptacle.
Double bagging is available upon request.
If you prefer that waste not be placed in your trash receptacle, we can double bag the waste and leave it in a mutually agreed-upon location for you to place in your trash on garbage day.
Ladybug Scoops takes sanitation and cross-contamination prevention seriously. Our technicians use a kennel-grade disinfectant to clean and sanitize tools and footwear between properties.
9. Service Quality & Limitations
We make every reasonable effort to thoroughly clean the designated service area during each visit. However, due to the nature of outdoor dog waste removal, we cannot guarantee that every piece of waste will be located or completely removed during every visit.
Waste may be difficult or impossible to see when hidden by tall grass, leaves, debris, landscaping, vegetation, snow, or other materials.
Soft, wet, mushy, or diarrhea-type stool may not be completely removable and may leave residue on grass, landscaping, concrete, or other surfaces.
Ladybug Scoops is not responsible for waste that cannot reasonably be located or completely removed under these conditions.
10. Weather & Unavoidable Service Interruptions
Ladybug Scoops operates in a variety of weather conditions and generally works rain or shine.
Service may be delayed, rescheduled, or canceled when weather, road conditions, air quality, wildfire activity, natural disasters, or other circumstances make travel or outdoor work unsafe.
We will make reasonable efforts to communicate significant service changes and complete delayed service as soon as reasonably possible.
Because recurring monthly pricing is annualized and accumulated waste must still be removed during a subsequent visit, weather-related missed services are generally not eligible for credit.
11. Holidays
Ladybug Scoops technicians do not perform regular service on Thanksgiving Day.
Ladybug Scoops also observes an annual holiday closure beginning December 25 through December 31. Regular route service resumes following the holiday closure.
Holiday-related missed visits are built into our annualized recurring service model and are not eligible for credit. Accumulated waste will be removed during the next scheduled service.
12. Temporary Service Pauses
Active recurring-service customers may request a temporary pause of service for up to 90 days.
Customers who resume service within 90 days may return at their previous service rate, subject to route availability and any material changes to the property, number of dogs, or service requirements.
After 90 days, the account will be considered inactive. Customers returning after that time will be subject to current pricing, route availability, and any applicable initial cleanup charges.
A customer-requested temporary pause is different from a payment-related service suspension.
13. Canceling Service
Ladybug Scoops service is month-to-month and does not require a long-term contract.
If you no longer wish to receive service, you must notify Ladybug Scoops before the beginning of the next billing month.
Because monthly service is prepaid, credits or refunds are not issued for partial months after the new service month has begun.
Cancellation ends recurring service. Customers who later wish to restart service may be subject to current pricing, route availability, and any applicable initial cleanup charges unless the account qualifies as a temporary service pause as described above.
14. Right to Refuse, Suspend, or Discontinue Service
Ladybug Scoops reserves the right to refuse, suspend, or discontinue service when reasonably necessary, including when:
- A dog or property presents a safety concern
- Safe or reliable access is repeatedly unavailable
- An account remains unpaid
- Property conditions create an unreasonable risk to our technicians
- Service requirements have materially changed
- A customer engages in threatening, abusive, harassing, or inappropriate behavior toward our employees or representatives
- Continued service is otherwise unsafe, impractical, or outside the scope of the services we provide
Immediate termination may occur when necessary to protect the safety of our employees, contractors, customers, or animals.
15. Media Release
By using our services, you grant Ladybug Scoops permission to take and use photographs, video recordings, and/or audio recordings of your property and dogs for promotional, marketing, educational, and advertising purposes.
This may include lawns, yards, dogs, landscaping, or other outdoor areas associated with the services we provide. Content may be used on our website, social media accounts, digital advertising, print materials, or other marketing channels.
Ladybug Scoops will not intentionally disclose identifying customer information such as customer names, street addresses, account information, or other personal details in promotional materials without prior permission.
16. You may opt out of promotional photography or recording at any time by contacting our office.
Routine photographs taken for operational or service-verification purposes, including secure gate photos, are considered part of our normal service documentation and are separate from promotional media use.
17. Liability & Service Limitations
Customers are responsible for maintaining gates, fences, latches, locks, and other property features in safe and functional condition.
Although our technicians take reasonable precautions to prevent dogs from escaping, Ladybug Scoops is not responsible for an escaped dog when the escape results from a defective, damaged, improperly secured, or malfunctioning gate, fence, latch, or lock; inaccurate access instructions; or a customer's failure to secure a dog after being instructed to do so.
If we identify an apparent problem with a gate, latch, fence, or other access point, we will make reasonable efforts to notify the customer.
Customers are responsible for notifying Ladybug Scoops of known hazards or unusual conditions on the property that could reasonably affect the safety of our technicians or the performance of the service.
To the extent permitted by applicable law, Ladybug Scoops is not responsible for damage or loss resulting from pre-existing property conditions, ordinary wear and tear, hidden hazards, defective gates or fences, landscaping conditions, or circumstances outside our reasonable control.
Nothing in these Terms of Service is intended to waive or limit liability where such a waiver or limitation is prohibited by applicable law.
18. Authorization & Agreement
By initiating service with Ladybug Scoops, you:
- Confirm that you have read and agree to these Terms of Service.
- Give Ladybug Scoops and its employees and authorized contractors permission to enter the designated areas of your property for the purpose of performing scheduled services.
- Confirm that you are authorized to provide access to the property.
- Authorize Ladybug Scoops to charge the credit or debit card on file for recurring monthly service and other authorized or applicable charges associated with your account.
- Agree to provide accurate information regarding your dogs, property, access, and service requirements.
- Agree to notify Ladybug Scoops when information affecting your service changes.
Ladybug Scoops may occasionally update these Terms of Service to reflect changes in our services, policies, pricing structure, safety procedures, or applicable requirements.
When material changes are made, we will make reasonable efforts to provide notice. Continued use of Ladybug Scoops services after updated terms become effective constitutes acceptance of the revised Terms of Service.
